  • Dentists and dental hygienists: Required at initial licensure and CE renewal

What are Florida's HIV confidentiality rules?

Florida law imposes strict confidentiality protections for HIV-related information that go beyond HIPAA. Unauthorized disclosure of HIV test results is a criminal misdemeanor. Access to HIV records is limited even within the healthcare organization. Written specific authorization is required for most disclosures.

What is opt-out testing?

Under Florida law, HIV testing follows an opt-out model. Patients are informed that an HIV test will be performed as part of routine care and may decline (opt out).
